Eligibility For Membership

To be eligible for membership in the American Legion, a veteran must have served at least one day of federal active duty since December 7, 1941, and received an honorable discharge (or discharge under honorable conditions)
Because of the federal LEGION Act signed into law, the historic "wartime eras" restriction was opened up.
The American Legion now recognizes the entire period from Pearl Harbor to the present day as an ongoing open eligibility window.

Core Eligibility Criteria

  • Minimum Service: At least one day of active federal military duty.
  • Discharge Status: Must be Honorable or under honorable conditions.
  • Eligible Branches: U.S. Army, Navy, Marine Corps, Air Force, Space Force, and Coast Guard.
  • Timeline: Any service from December 7, 1941, to the present (plus the historical window of World War I: April 6, 1917, to November 11, 1918).

National Guard and Reserve Members

Members of the National Guard and Reserves are fully eligible if they meet the same core requirements. They must have served at least one day on federal active duty (Title 10 orders), which explicitly includes federal status for basic training and military tech schools. Traditional local weekend drills and annual summer training under state orders (Title 32) do not qualify on their own. [7, 8]

Special Groups & Extensions

  • Active Duty Personnel: All personnel currently serving on active duty are considered eligible veterans and can join immediately.
  • Merchant Marine: Eligible only if their active service occurred during World War II, specifically between December 7, 1941, and December 31, 1946
  • Allied Forces: Citizens of the United States who served on active duty in the military forces of governments allied with the U.S. during the eligible timelines are also qualified.
